Injuries and Diseases Covered by the Workers’ Compensation Insurance

Each state has his or her systems and regulations that govern the Work Comp program. This includes features such as benefits, classification of injuries and impairments, medical care, insurance management, claims, and resolutions.

Certain adjustments have to be considered also in case of business expansion across states. Since laws differ per state, the previous specific provisions from the originating state may no longer apply to the new business location. However, standard general provisions can still be used to build to serve as a framework in drafting the policy.


Four types of work-related related injuries qualify for workers’ compensation:

  • Physical injuries developed on the job due to continuous exposure to dust, toxins, deafness, and repetitive motion injuries like carpal tunnel.
  • Aggravated pre-existing conditions like back injury due to prolonged sitting, among others.
  • Injuries suffered during company-sponsored activities (ex: team building), use of facilities, and amenities even during breaks while inside the company premises.
  • Injuries due to work-related stress, and those that resulted from mental or physical strain due to increased workloads and harassment.

In addition to these, contracted due to exposure to toxins under normal working conditions such as lung conditions are also covered.

However, not all injuries that an employee suffered at work are covered under this program. These exemptions include:

  • Self-inflicted injuries, including suicide and caused by a person who instigated a fight
  • Injuries caused by a violation of a company policy
  • Injuries due to intoxication or illegal substance abuse
  • Injuries which are not job-related
  • Injuries which the employee suffered outside work
